FUNDAMENTAL RULES
F.R. 12 (a) 1 Two or more employees may not be recruited into a permanent post at the same time.
F. R. 12 (b) A govt employee should not be employed in 2 or more posts at once. *
F. R. 12 (c) If the employee is on leave, no one else should be appointed to that post. *
F. R. 15 (b) Employee can also take 1 day medical leave.
F. R. 18 No employee shall be granted leave of more than 5y at a time unless appointed by govt.
F. R.18 (a) If he is on leave without permission for more than 1y, he is considered to have resigned.
F.R.18 (b) If he is on leave for more than 5y with / without permission then he is considered to have resigned from the job.
F. R.18 (c) Calculated that he resigned from the job while in Foreign Service for more than 5y.
F. R.22 (a) When appointed to a post with higher priority duties than the current post duties will be stabilized at the above stage on a new scale above the current salary.
F. R.22 (a) (iv) When an employee is selected for another post by APPSC the salary will be fixed in the newly selected post not less than the salary in the old post. The increment will be given only after 1y from the date of joining the new job. The increment date in the old post will be lost.
FR22 (B) When promoted from one post to another, a notional increment added to the salary received in the following post should be determined at the promotion stage post scale at the above stage. The promoted employee has the option of 2 types of salary confirmation. (a) Date of promotion (b) Option to give increment date in the following post.
@ F. R.24 The annual increment is approximate. If the employee's behavior is not satisfactory, his increment may be revoked.
Ex Suppose an employee takes 2 increments as punishment after taking increments on 1.6.10.
(a) with cumulative effect
Doing so brings only one increment to 1.6.13
(b) with out cumulative effect
Doing so will result in 3 annual increments for 1.6.13, i.e. 2 annual increments as arrears are lost.
F. R.26 Includes Terms and Conditions of Service to be considered.
Time worked on a time scale is calculated in increments.
So the annual increment will be deferred till the end of the pay loss leave.
Head of department is empowered to issue increments without delay of increment date on purchase of pay loss leave for medical reasons up to 180 days.
F.R.26 (a) If the employee is entitled to any exemption due to passing any examination then that facility shall be deemed to have been granted from the next date of the last examination.
Newly hired or promoted employee will be granted his annual increment for less than 12 months.
Ex: The first annual increment of the employee who joined the job on 19.12.73 will be sanctioned on 1.12.74.
The date of retirement of an employee should be calculated as notional grant for pentionery benefits while the next day is the annual increment date.
So this does not apply to things like leave encashment.
F. R.44 HRA can be granted in full for up to 4 months while the employee is on leave.
F.R.49 govt can hire one employee temporarily for 2 posts.
F.R.49 (a) This way when looking at 2 posts whichever has the highest salary, that salary can be granted.
1/5 part of the first 3 months salary and 1/10 part allowance for the next 3 months when the employee also manages the additional post.
